1. Acceptance of Terms

By creating an account or using our Services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a legally binding agreement. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Description of Services

Kreative Koala LLC provides tools designed to assist users in tasks such as clipboard management, spreadsheet management, email composition, meeting organization, calendar scheduling, document scanning, puzzle and quiz applications, photo and video management, duplicate photo detection, contact deduplication, storage cleanup, and productivity enhancement. The Services are intended to enhance productivity and streamline workflows.

3. User Responsibilities

You agree to:

• Use the Services only for lawful purposes.
• Provide accurate and complete information when creating your account.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.

You agree not to:

• Reverse-engineer, decompile, or disassemble any aspect of the Services.
• Use the Services to send spam, harass others, or engage in fraudulent activities.
• Introduce malware, viruses, or other harmful code into the Services.

4. Subscription and Fees

Some features of the Services may require a subscription or one-time payment. Pricing, payment terms, and refund policies will be outlined at the time of purchase and are incorporated into these Terms by reference.

Auto-Renewable Subscriptions

Certain Services offer auto-renewable subscriptions. By purchasing an auto-renewable subscription, you agree to the following:

• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Free Trials: Some subscriptions may include a free trial period. If a free trial is offered, you will not be charged during the trial period. At the end of the free trial, your subscription will automatically convert to a paid subscription and your Apple ID account will be charged the subscription price unless you cancel at least 24 hours before the end of the trial period.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription price.
• Managing Subscriptions: You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase.
• No Cancellation of Current Period: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Current subscription offerings and pricing are displayed within each app at the point of purchase. Subscription details, including the title, length, and price of each subscription, are also available in the app.

5. Intellectual Property

All intellectual property rights in the Services, including but not limited to software, content, trademarks, and designs, are owned by Kreative Koala LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services as permitted by these Terms.

6. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Services, you consent to our data practices as described in the Privacy Policy.

7. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for any such changes.

To the maximum extent permitted by law, Kreative Koala LLC and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless Kreative Koala LLC, its affiliates, and its employees from any claims, liabilities, damages, or expenses arising from your use of the Services or violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Travis County, Texas.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or other means. Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.
